Terms & Conditions
Definitions
- Habits BV: The legal entity Habits BV, located at Stationsstraat 80a, Lendelede, Belgium, which offers fitness club services and products under the name Habits.
- Club / Location: The physical location(s) where Habits BV provides fitness activities.
- Agreement: The agreement between Habits BV and the Member upon registration, including these Terms and Conditions and any selected options.
- Effective Date: The date on which the Member registers for membership. For presales, the opening date of the Club is the Effective Date.
- Member: A natural person aged 16 or older who subscribes to membership with Habits BV.
- Membership Card or QR-Code: Required for club access.
- Options: Additional services or products available in addition to the standard membership.
- Welcome Offer: Introductory benefits such as a free trial period or discounted rate, as indicated on the website or in the Club.
Membership Registration and Right of Withdrawal
- Members can register online
- Right of Withdrawal: Members who register online have the right to cancel the membership within 14 days. If the membership was not used during this period, the cancellation is free of charge. If used, Habits BV may charge a pro-rata fee.
- Flexible membership options are automatically renewed, with a one-month notice period for cancellation without fees.
Membership Duration and Types
- Membership Types: Members may choose from various membership levels with different access privileges. See the website or inquire at the Club for details.
- Club Access and Options: Basic membership grants access to the designated Club, while Premium membership offers access to all Clubs.
Additional Services (Options)
- Additional services or products may be added to the membership for a fee. Current pricing can be found on the website or in the Club.
- Options can be terminated at any time with a four-week notice period.
Rates and Payment
- Membership fees are due from the registration date and are collected via SEPA direct debit or credit card, depending on the payment structure.
- Habits BV reserves the right to adjust rates and conditions after the contract period. Members will have one month’s notice for cancellation without fees if they disagree with changes.
- Late payment may result in temporary suspension of club access and additional fees in compliance with Belgian law.
QR Code and Membership
- The QR Code is personal and can’t be shared with other people or friends. Sharing your QR code with other people to enter the club may result in suspension of club access
Opening Hours
- Habits BV reserves the right to adjust opening hours as needed.
- Some clubs may operate without staff during certain hours. During these times, a safety system and panic button are available.
Moving or Injury
- Memberships can be suspended for medical reasons upon submission of a medical certificate. A one-time administrative fee of €5 applies.
Membership Termination
- Fixed-term memberships can be canceled with four weeks’ notice before the end of the term.
- Flexible memberships can be canceled at any time with four weeks’ notice.
- Habits BV reserves the right to terminate memberships for violations of club rules or inappropriate behavior.
Risk and Liability
- The use of facilities is at the Member’s own risk. Members are advised to consult a medical specialist if unsure of their physical fitness.
- Habits BV is not liable for loss, theft, or damage to personal belongings, except in cases of gross negligence.
Complaints
- Members can submit complaints via [email protected]. If unresolved, disputes may be referred to the consumer mediation service.
Personal Data and Privacy
- Habits BV processes personal data in accordance with GDPR. See the privacy policy on the website for details.
- Security cameras may monitor common areas but are not installed in locker rooms or restrooms.
Change of Personal Information
- Changes to personal details must be updated through Habits’s Clubplanner app. Costs arising from failure to update information may be charged to the Member.
House Rules
- The club’s house rules are available in the Club and on the Habits website. Failure to comply may result in temporary or permanent exclusion.

Applicable Law and Disputes
- These Terms and Conditions and all agreements with Habits BV are governed by Belgian law.
- Disputes will be handled by the court in the Member’s place of residence or may be resolved via the EU online dispute resolution platform: http://ec.europa.eu/consumers/odr/.
Language and Interpretation
- In case of any dispute or interpretation differences, the Dutch version of these Terms and Conditions will prevail to avoid issues related to connotation or meaning.
